How to get a coffee cart permit in New York.

New York is really two permitting systems, and which one applies to you changes everything about your timeline and your business model.

Outside New York City, a coffee cart is a mobile food service establishment permitted by the county health department, or by a district office of the state Department of Health in some counties. That process looks like the rest of the country: application, commissary, plan review, inspection, two to four weeks.

Inside the five boroughs, mobile food vending is capped, but the cap is finally moving. Local Law 18 of 2021 required up to 445 new full-term permits a year for ten years starting July 2022, and Local Law 54 of 2026 went further: together they add 12,780 permits by 2031. The waiting list, closed for years, has reopened in application windows, most recently with a deadline of April 28, 2026.

So the honest 2026 read is neither "impossible" nor "just apply". Supply is still far below demand and an unsanctioned secondary market for permits still exists, but a legitimate route now exists that did not a few years ago. If you want a street cart in NYC, get on the waiting list in the next window and plan your business around something else until your number comes up.

Local Law 18 also created a supervisory license, required for anyone vending from a newly permitted unit. The Health Department began offering these on July 1, 2026, for five consecutive years: 1,500 a year for boroughs outside Manhattan, 500 a year covering all boroughs including Manhattan, and 200 a year reserved for disabled people and US veterans.

Meanwhile the path that works today is not street vending at all. Private events on private property, corporate offices, and venue work are generally handled under temporary event permits or under the host venue, rather than a full-term mobile food vending permit.

Upstate and on Long Island, county mobile food service permits generally run $200 to $600 a year. Westchester, Erie, Monroe, and Onondaga counties all sit in that band. Plan review, where required, adds $50 to $200.

In New York City the sticker price is misleading. The full-term mobile food vending permit itself is a modest two-year fee, but the permit is capped and the waitlist is closed, so the number on the fee schedule is not a number you can actually pay to get one. Treat published NYC permit fees as irrelevant to your planning unless you already hold a permit.

For NYC private event work, the relevant costs are a temporary food service event permit per event, venue and building requirements, certificates of insurance, and a commissary. Commissary agreements in the New York metro are the most expensive in the country, commonly $400 to $900 a month.

Both tracks require a Food Protection Certificate. In NYC that means the Health Academy course, which is inexpensive but must be held by the person supervising the operation.
